1. Liquor may not be brought onto the premises without prior written consent from management.
2. Intoxicated persons will not be permitted entry to the premises.
3. Guests who are intoxicated, argumentative, quarrelsome, aggressive or disorderly will be removed from the Premises.
4. Smoking and/or Vaping is not permitted indoors.
5. Professional, commercial, staged or organized photography or video recording is not permitted without prior authorisation.
6. Tripods, lighting, other standalone ancillary photography or video equipment is not permitted.
7. Any type of activity or item that may impact on other Guests safety or enjoyment whilst on the Premises is not permitted.
8. The Premises is under 24-hour CCTV surveillance for the safety and security of all visitors and staff. By entering, you consent to being recorded.
9. All persons under 18 years of age must be accompanied by a parent or supervising adult at all times.
10. Adults/Carers/Guardians are responsible for persons under their supervision.
11. Under our licensing conditions, timing is not permitted for kids karting sessions for participants aged 6 to 15 years.
12. You must obey all reasonable verbal or written instructions / warnings given by Eastern Creek Karting Staff.
13. Appropriate clothing and footwear must be worn at all times.

PHOTOGRAPHY POLICY

1. Eastern Creek Karting, on occasion, may take photographs of guests within the venue for a number of purposes not limited to but including:

   i.   Mementos for groups and individuals conducting an event
   ii.  Display on in venue televisions and displays
   iii. Training and development purposes.

2. By entering the Premises you consent for us to take video and images for security and promotional purposes of yourself and, or any child/person you are responsible for.
3. Any photographs, videos or sound recordings taken by guests must be limited to their own attendees and are for personal enjoyment only. Any use, reuse or production for commercial purposes without our express written consent is strictly prohibited.
4. Go-Karting participants may bring a GoPro or similar action camera to record their experience, provided they use their own mount and securely attach the camera to the kart only. For safety reasons, cameras are not permitted on helmets or restraints.

PROMOTIONAL AND ADVERTISING MATERIAL

By providing us with your email and/or phone number you consent to receiving promotional and advertising material from time to time. You may opt out from receiving this information at any stage.

ARRIVAL & CHECK IN

1. Arrival is strictly 30 minutes prior to your scheduled session time.
   All participants must arrive at least 30 minutes before their scheduled session to register, sign a waiver, and attend a mandatory safety briefing before participating, regardless of prior visits.
2. All participants must check in at the reception desk upon arrival.
3. Late arrivals will forfeit their session without refund or rescheduling, as we are unable to delay subsequent sessions or guarantee availability of a later time slot.

SAFETY & CONDUCT

1. Go-Karting is a potentially dangerous activity and may result in serious injury, including death.
2. Providing false or misleading personal information is strictly prohibited to ensure the safety of all participants.
3. Staff may remove drivers from sessions without refund if they fail to meet age, height, or weight requirements.
4. Eastern Creek Karting reserves the right to revoke permission for patrons to remain on or return to the premises if necessary.
5. Participants are responsible for meeting all health and safety criteria before entering the track.
6. Drivers are not permitted to kart if they have consumed alcohol or drugs. Blood alcohol content (BAC) must be 0.00, and drivers must not be under the influence of any substances.
7. Karts have a maximum weight limit of 120kg per driver.
8. Track rules will be instructed prior to each session and must be followed at all times.
9. Drifting, dangerous driving and colliding with other karts/barriers is NOT permitted. Drivers engaging in this behaviour will be disqualified from sessions without refund or reimbursement.
10. Kart selection is strictly determined by the Driver’s AGE. Adult and Junior karts are not permitted in the same sessions.

IDENTIFICATION REQUIREMENTS

1. PHYSICAL CREDIT CARD
   For your security, at check-in you are required to present the physical copy of the credit card that was used to pay for your booking and matching valid photo identification.
   The name listed on your credit card must be identical to the contact name listed on your booking.
2. PROOF OF AGE
   i. All drivers and passengers aged 16 or older must provide proof of age with a government-issued photo ID, such as a Driver’s Licence, Photo ID Card, or Passport.
   ii. Drivers under 18 must have a Guardian aged 18 or older present during all sessions and provide proof of age with a government-issued photo ID, such as a Driver’s Licence, Photo ID Card, or Passport.

DRESS STANDARDS

1. All participants must wear fully enclosed footwear.
2. Long hair must be completely secured inside a hairnet/balaclava, and helmet to ensure it cannot come loose during racing.
3. NO SCARVES, HOODED TOPS, SINGLETS, SLEEVELESS TOPS OR LOOSE CLOTHING are permitted when driving. All tops and shirts must cover your shoulders.
4. Full-face helmets will be provided on-site.
   If you prefer to bring your own helmet, it must be a full-face helmet that complies with Australian Standards.
   Motocross helmets with goggles are permitted; however, visors and goggles must not be tinted when driving at night.

HEALTH EXCLUSIONS

1. Karting is an intense and potentially dangerous activity, and participants must ensure they are physically fit to take part. Individuals with health conditions that may impair their driving or make it unsafe to participate are NOT permitted on the track.
2. Pregnant women and individuals with pre-existing health conditions that could affect their ability to drive are not allowed to participate.
3. Customers with high blood pressure, heart conditions, or back/neck issues should seek medical clearance before participating.
4. If you have any doubts about your ability to participate, you must seek medical clearance prior to you making a booking.

Please read and acknowledge the information below as it applies to all individual participants:

EASTERN CREEK KARTING PTY LIMITED, ABN 37 166 631 965, located at 50 Peter Brock Drive, Eastern Creek NSW 2766 (“the premises”), offers recreational services, including go-kart hire and use, as well as access to the premises and surrounding areas.

Eastern Creek Karting will ensure that the facilities are operated with due care and skill and that the equipment and facilities will be suitable for the purpose for which they are used.

Section 1 – YOU ARE AWARE OF THE FOLLOWING:

1. Go-karting is potentially dangerous activity and may result in serious injury, including death.
2. The go-karts provided by Eastern Creek Karting operate at speeds in excess of 80km/h.
3. Zero Tolerance to drug and alcohol (0.00 BAC) with the use of the go-karts.
4. The use of Mobile phones, and consumption of food and drink is not permitted within the areas of the Go-karting track.
5. The maximum weight limit for an individual go-kart is 120kg.
6. For safety reasons, pregnant women, and people with certain pre-existing health conditions are not permitted to use the go karts.
7. All hire kart drivers and passengers must watch the mandatory safety briefing video before using the go-karts, regardless of whether it has been watched on a previous visit. If you require any assistance or clarification, please ask the track supervisor for guidance.
8. Eastern Creek Karting reserves the right to refuse you, without limitation, entry to the premises, which includes but is not limited to the go-kart track, waiting areas, spectator zones, parking lots, event areas, and any other property owned, leased, or controlled by Eastern Creek Karting. At any time, Eastern Creek Karting may withdraw its consent for you to remain on or return to the premises.
9. If any Eastern Creek Karting staff member has any doubts about your ability to drive or believe that you are under the influence of either drugs or alcohol, then you will be not permitted to use any of the activities, and you may be asked to leave the premises.

Section 2 – YOU AGREE TO THE FOLLOWING:

1. I VOLUNTARILY ASSUME ALL RISKS involved in or arising from my use (whether in accordance with these terms or conditions or otherwise) of any go-karts, equipment, services, facilities provided to me by Eastern Creek Karting, including without limitation, the risk of death, bodily injury, or property damage.
2. I AGREE that I will comply with all rules and safety instructions provided by any Eastern Creek Karting employee or agent, including these Terms & Conditions and any signs displayed on the premises. I understand that I am required to undergo a mandatory safety briefing, which includes watching a safety video, regardless of any previous visits. If I do not fully understand any instructions, I will seek clarification from a manager to my satisfaction. I further agree and acknowledge that by using any go-kart, equipment, service, or facility provided by Eastern Creek Karting, I represent that I have read and understood all rules and safety instructions, including these Terms & Conditions and all signs displayed on the premises.
3. I AGREE to pay the cost of and authorise Eastern Creek Karting to take all steps it considers reasonably necessary to protect or ensure my welfare in the event of an incident or personal injury occurring at the premises, including but not limited to, obtaining medical treatment and/or transportation to a medical facility for me/or any minor(s) for whom I am responsible.
4. I AGREE that I am responsible for, and that I shall immediately pay for damage caused to the premises, go-karts, equipment, facilities and/or personal property of any other person caused by me or any minor(s) for whom I am responsible.
5. I AGREE AND HEREBY GRANT PERMISSION to Eastern Creek Karting and their agents and employees to use my image or likeness, in whole or in part, in any marketing or promotion material whatsoever.
6. I AGREE, ACKNOWLEGE, WARRANT AND REPRESENT THAT I AM NOT UNDER THE INFLUENCE OF DRUGS. I further agree and acknowledge that Eastern Creek Karting operates under a strict zero tolerance to drugs policy. I agree to comply with a breath test administrated by Eastern Creek Karting staff at any time and that my refusal to do so may result in Eastern Creek Karting refusing me the right to drive or use any other services provided. I agree that my blood alcohol level is (0.00 BAC) when wanting to participate in activities.
7. I AGREE AND UNDERSTAND if I am participating in an inappropriate manner, using inappropriate wording or being aggressive towards staff or fellow patrons I may be asked to leave the premises and may not be NOT allowed to return or may be refused entry into Eastern Creek Karting.
8. I WARRANT AND REPRESENT THAT I AM IN GOOD HEALTH and free from any pre-existing health or medical conditions which may prevent me from safely operating the go-karts or participating in any other activities. I understand that I am required to notify Eastern Creek Karting staff immediately if I have any health conditions that may impact my ability to safely participate in any activities.
9. TO THE FULLEST EXTENT ALLOWED BY ANY APPLICABLE LAW, I HEREBY RELEASE EASTERN CREEK KARTING, its directors, employees, agents, partners, affiliates, landlords, event sponsors, and contractors from any and all liability to me, or any third party, for any loss, injury, or damage, howsoever arising, including, but not limited to, accidents, injuries, or other damages caused by the negligence (whether active or passive) of Eastern Creek Karting, its directors, employees, agents, contractors, partners, affiliates, landlords, event sponsors, or any other third party..
10. I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS EASTERN CREEK KARTING, and its directors, employee’s, agents, partners, affiliates, landlords and event sponsors and agree to continue to keep the same always indemnified in respect of any loss, claim, cost, liability, demand, or legal expense made by any other person, arising from my use of the goods and/or services provided by Eastern Creek Karting, including any claim for bodily injury, property damage, or any third-party actions arising from such use ( including, but not limited to driving go-karts or using other activities) provided by Eastern Creek Karting and/or my failure to comply with the terms of this document, including any breach of representation or warranty.
11. I AGREE to behave in a responsible, respectful, and non-disruptive manner at all times while at Eastern Creek Karting. I understand that inappropriate behaviour, including aggression, verbal abuse, or failure to comply with safety instructions, will result in immediate removal from the premises, and may result in permanent or temporary refusal of entry or participation in any activities at Eastern Creek Karting.
12. IF AM SIGNING THIS DOCUMENT ON BEHALF OF A MINOR, I confirm that I am the legal parent or guardian of the minor, and I acknowledge that I have read, understood, and agree to the terms and conditions outlined in this waiver on behalf of the minor. By signing this waiver, I consent to the minor’s participation in go-karting and related activities at Eastern Creek Karting, and I assume full responsibility for their safety, conduct, and adherence to all rules and instructions during their visit. I agree to indemnify and hold harmless Eastern Creek Karting, its directors, employees, and agents from any liability arising from the minor’s participation. The minor shall be bound by all terms of this agreement as if they were an adult participant.

By agreeing with these terms & conditions, you will be agreeing that your rights to sue the interested parties listed in Section 2, points 9 and 10, under the Australian Consumer Law and other legislation if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence. Gross negligence refers to a severe and reckless disregard for the safety or wellbeing of others, and includes actions or omissions taken with wilful disregard for the known risks and consequences or conduct that demonstrates complete indifference to the potential for harm. In cases of gross negligence, the rights to sue for damages are not excluded, restricted, or modified under this waiver.

1. Prior to visiting our venue all participants that are part of an event or group booking must read and familiarise themselves with the following terms & conditions:

2. All participants are required to read, understand, and sign a Risk Warning & Kart Hire Waiver.

3. Event bookings must adhere to minimum participant numbers to qualify for Grand Prix Packages and secure track exclusivity.
4. Liquor may not be brought onto the premises without prior written consent from management. If consent is given to bring alcohol onto the premises, it may only be consumed after all group or party members have completed their race sessions.

PAYMENTS

1. A non-refundable deposit of $500 is required for all event bookings. Reservations will not be confirmed until the deposit has been received.
2. The balance payment is due 5 days before your event date, and payment must cover the full number of participants booked. No refunds will be issued if fewer drivers attend on the day.
3. A surcharge will apply to all credit card transactions:

–   American Express – 2.8%
–   VISA/Mastercard – 1.6%

CHANGES/CANCELLATIONS/REFUNDS

1. Cancellation of an event booking must be submitted in writing to events@eck.com.au . Deposits will not be refunded. Charges for food will not be refunded if cancellation occurs within 2 days of the event.
2. Event bookings may be rescheduled up to 7 days before the event date without any penalty or additional charges, subject to availability of the new date.
3. If you wish to reschedule your event within 7 days of the event date, a $200 administration fee will apply.
4. If participants arrive late or fewer drivers than booked attend, the session will be forfeited, and no refunds will be issued.
5. In unsafe weather conditions (e.g., heavy rain, wet tracks, or extreme heat), track operations may be suspended, and bookings will be rescheduled.
6. Management will notify you as early as possible to reschedule if your booking is impacted by unsafe conditions.
7. Refunds will not be issued for weather-related disruptions.

ONLINE PURCHASE

1. Gift Cards available for purchase online are for sale to adults over the age of eighteen (18) years. By proceeding to purchase a Gift Card through our website, you acknowledge that you are over 18 years of age.
2. All prices are in Australian Dollars (AUD) and are inclusive of GST. Our prices are available on our website, and we reserve the right to amend our prices at any time.
3. Please note that all online bookings are subject to a service and booking fee, which is charged by our third-party booking provider. This fee applies to all online orders and is non-refundable. By proceeding with an online booking, you acknowledge and accept these additional charges.
4. We accept payments for Gift Card purchases online via Mastercard, VISA and AMEX.
5. When you order a Gift Card from us, we require you to provide your name &/or recipients name, email address, telephone contact and credit card details. We undertake to take due care with this information; however, in providing us with such information you accept that we are not liable for its misuse due to error in transmission, virus, or malware.
6. We undertake to accept or reject your Gift Card order within Seven (7) days. If you have not received an order confirmation email within Seven (7) days, your offer is deemed to be rejected.
7. Once you have submitted a Gift Card order, you may not cancel that order even if our acceptance or rejection of your offer is still pending.

TERMS OF USE

1. By purchasing or using the Gift Card, you agree to be bound by these terms and conditions.
2. Gift Cards are to be treated like cash. Defaced, mutilated, altered, lost or stolen Gift Cards will not be replaced, refunded, or redeemed.
3. The credit balance on the Gift Card can be redeemed for purchases both online and in person at Eastern Creek Karts for all available go-karting activities.
4. Gift cards are not redeemable for cash, cannot be re-sold and cannot be reloaded.
5. Gift cards expire 36 months from the issue date, at which time any unused balance will be forfeited.
6. If a purchase exceeds the available Gift Card balance, you must make up the difference with another payment method.
7. No change will be given for any unused Gift Card balances.

CHANGES & CANCELLATIONS
